lieze Posted September 12, 2011 Report Posted September 12, 2011 I hesitated to apply for disability and it actually took my boss saying okay enough is enough for me to decide it was time to go that route. Now I really wish I would have gotten the ball rolling sooner due to the length of time I've heard others report it takes to get a settlement.I applied July 13 th.Have spoken to my case worker a couple times.The last time he took down info to report to Columbus ( I am in Ohio ) and also had me call my place of employment and have them send over my wage earnings for 2009 2010 I have not worked in 2011.My full time ended Oct 2009.Then 2010 I worked about 4 days per month.So he has said I may be eligible for some back pay.I'm hoping that this can happen without having to share a portion with a lawyer but I am trying to be realistic also.Well the last event was I received a packet on Sept 7th?Dated September 1st and it was a symptom report.It was 4-5 pages long and I was to submit it within 10 days.I whipped it out that evening and faxed it the next day...So I'm waiting again and hoping more and more that this goes through.Anyone else relate to being at this point? icesktr189 Posted September 13, 2011 Report Posted September 13, 2011 I would get a lawyer asap. I got denied the first time. I just did my second symtpoms list again and should be hearing back from thrm soon with a decision. It has already been a year... It takes forever! My dad got lucky and his was approved on reconsideration. Dont give up hope though. Some do get it on the first try but its really uncommon. I would definently get a lawyer and you dont have yo pay anything back.Good luck!! Its a long process, but hopefully it will pay out for us Quote
lieze Posted September 13, 2011 Author Report Posted September 13, 2011 That was actually what I did first was contact a lawyer that deals with disability.They took down my story and told me to go ahead and apply online and contact them as soon as I got my denial.They gave me the first hope that based on symptoms alone I had a case.I don't have an official POTS diagnosis it was more of a possibilty my family doctor threw out there.As I've said in other posts I don't think she really understands ( my family doctor ) how much I am impacted with this.The times I have gone in with specific concern I don't feel she has been able to help me with anything that has improved my condition at all.I have been to ER more than I have had visits with her-that's not a good sign and I'm not trying to blame her.I'm not sure there was anything that could be done-I think I just have to live with this.I think I started out the disability process thinking we'll just see what they say...now that I am just 2 months into it I'm feeling anticipation of what will happen next and really hoping I'll have some kind of answer soon so I can go to the next stage. Long story and ill introduce myself in a new thread-ive been following the board for a while and only just found out that i could reply... I think what really helped my case,in addition to a lawyer, was having the lawyer read and present to the judge a medical paper describing pots and how it affects people who have it.maia Quote

potsgirl Posted September 14, 2011 Report Posted September 14, 2011 It took me about 1 1/2 years to get my disability approved, and that was in court with a good disability lawyer. From what I've heard, in most cases, we are turned down the first time and then with the appeal. I think quite a few people end up going to court, and you really need to get a lawyer after you've been denied the second time, or before that. The judge didn't need any time for consideration, he approved me at the court hearing. I got quite a bit of backpay, which was very helpful. I applied for disability the month that I had to quit work, thank God. It was still a very long time, but I was lucky enough to also get disability from my county job.Hope it goes well for you! Quote

Actually it was a month shy of 2 years.. brain fog.. oh definitely a sigh of relief! with everything else that we deal with, and almost going over the deep end several time since i was diagnosed, losing my house would have finished me off.
